The big difference is that Trump, as President, had the authority to summarily change the classification of any documents. Biden, as vice president at the time he absconded with the documents was not, so if charged, he would have been convicted, because Vice Presidents only have executive privilege when dealing with the president.

Sun worked in various positions in the NYS government for ~15 years. She worked in Hochul's administration for only 15 months (Sept 2021 to March 2023) of those 15 years. During her time under Hochul, Sun was found out, terminated (in March 2O23), and reported to LE. Hochul and her administration are cooperating fully with the investigation and prosecution. The indictment appears to list 8 charges. The earliest item in evidence appears to be from 2015.
